Make your own cosmetics

If you don’t necessarily want to grow quickly, but you really enjoy making cosmetics yourself, then you have to ensure that your cosmetics are produced cleanly and safely.

What is the average duration to bring a fully compliant product to a market?

This depends on how far the product has been developed. When production is outsourced, a concept formula is often already ready and marketing is quick (< 4 weeks). When a factory makes a new formula for you, shelf life tests still have to be done (3-4 months).

When you produce yourself, you also have to buy good raw materials. Not every supplier provides enough information about these raw materials to approve them. This process can take weeks to months. And then the product can be made and it must be tested for shelf life for 3-4 months. So producing it yourself can quickly take up to half a year or even a year.

 

 

My company imports products from China, or via AliExpress - that's fine, right?

Unfortunately, more often than not, it isn’t really fine, based on our experience. The European cosmetics legislation is different from that of, for example, China or the USA. You usually need much more information about the product to comply with the law.

However, your suppliers are not always able or willing to share this information. As a result, your products cannot comply with European law. However, you are still fully responsible for your products, and all of the consequences these might have. That is why we recommend outsourcing the production of your products to a reliable partner that is familiar with EU legislations.

My products were examined by authorities and they do not comply. What’s next?

Why should I care about cosmetic compliance anyways?

As a Responsible Person you are legally obliged to sell safe products. Demonstrating product safety is done by creating a cosmetics safety assessment (or letting someone do this for you).

This safety assessment follows a standardized format which allows it to be easily checked by the authorities.

Which legislations applies to my cosmetic products?

The basic legislation is the Cosmetic Regulation. This is an EU law which is directly applicable to all cosmetics in Europe. This law is called EC 1223/2009.

The second important piece of legislation is the Cosmetics Claim Regulation EC 655/2013, which describes how to make correct claims for cosmetics.

Besides these two laws there are also other legislations that (in)directly apply to cosmetics. For example, think of the Aerosols Directive 75/324/EEG for cosmetics packaged in spray cans.
